Privacy and National Security Panel

Panelists talked about the tensions between civil liberties and national security. They focused on the Fourth Amendment and the Third Party Doctrine. The Third Party Doctrine, a controversial rule that grew from two Supreme Court cases, says an individual who gives information to a third party loses Fourth Amendment protections, and can include a Facebook posting or phone company information.

“Striking the Balance: Privacy & Security” was part of the Ninth Annual Homeland Security Law Institute held by the American Bar Association Section of Administrative Law and Regulatory Practice.
