The Supreme Court heard oral argument in Lee v. Tam, which concerns whether the government’s refusal to register trademarks that can be seen as disparaging, such as racial slurs, violates First Amendment free speech. The case arose from the U.S. Patent and Trademark Office’s refusal to trademark the name of an Asian-American rock band, The Slants, and challenges a 1946 trademark law barring the registration of trademarks that “disparage” groups and individuals.

On June 19, 2017, the court ruled unanimously that the government’s refusal to register trademarks that can be seen as disparaging violates First Amendment free speech.

This name of the case was changed to Matal v. Tam because Michelle Lee is no longer the director of the U.S. Patent and Trademark Office. Joseph Matal was the new interim director. close
