The Supreme Court heard oral argument in Fifth Third Bancorp v. Dudenhoeffer, a case concerning when employees can sue their companies over retirement plan losses. This case involved a claim by participants in Fifth Third’s employee stock ownership program (ESOP), in which the employees argued that the company’s fiduciaries violated their duties by continuing to offer the company’s stock through the plan after the stock had become devalued. An Ohio district court dismissed the case, but the U.S. Sixth Circuit Court of Appeals reversed the district court.

The Supreme Court on June 25, 2014, in a 9-0 opinion vacated the Sixth Circuit’s ruling and remanded the case back to the lower courts for further reconsideration. close
