The Supreme Court heard oral argument on the president’s recess appointment powers. In the case National Labor Relations Board v. Noel Canning, docket number 12-1281, the Court was considering the language, meaning, and history of the Constitution’s Recess Appointment Clause. At issue was whether President Obama overstepped his authority by making appointments to the National Labor Relations Board during a pro-forma session of the Senate. The Court was also considering when presidents can fill federal vacancies without the Senate’s “advice and consent.”
